1. This website (the “Website”) is controlled and operated by Gene Planet ltd (“We”, “us” and “our”). Please read the following terms and conditions (the “Terms and Conditions”) carefully as they set out the basis upon which we will grant you access to the Website and permit you to avail of the goods and services via the Website. Once you have read these Terms and Conditions click the “Accept” button at the bottom of the page to proceed. If you do not wish to proceed, click the “Cancel” button. By clicking the “Accept” button, you will be deemed to have accepted these Terms and Conditions and our privacy statement, so please review all these documents carefully.
2. We may revise these Terms and Conditions at any time and for any reason. Any such revised terms shall be posted on the Website and where such revisions are material they shall be notified to you by means of a notice on the Website indicating the date of revision and you shall be asked to confirm your acceptance to such revised Terms and Conditions by clicking on an acceptance icon.
3. These Terms and Conditions shall be governed by the laws of Ireland. The courts of Ireland shall have exclusive jurisdiction over any claims or disputes arising in relation to, out of or in connection with these Terms and Conditions.
4. You agree not to purchase any goods or services from this Website if such purchase is illegal in your home country.
Description of the Website
1. This Website provides users with information relating to our goods and services. It also provides users with the ability to purchase our goods and services and, where the user is our customer, with access to an account.
How to Order
1. This Website allows you to avail of the following goods and services:
  - You can purchase saliva collector kits so that you can provide us with a saliva sample and we can carry out genetic testing of your DNA;
  - You can purchase genetic testing of your DNA, the results, or partial results, of which will be delivered to your account on this website.
2. Ordering the above services is easy. [You simply select the number of saliva collector kits, the type of genetic testing and results (e.g. your genetic predispositions for certain diseases, reaction to modern medications, your physical and intellectual traits and/or where your ancestry used to live) you require and add it to your shopping basket. Adding an item to your basket does not commit you to buy as you can always remove it later. Once you have selected all the items you require you need, go to the checkout and pay for your purchases by following the simple instructions given there.]
3. Please ensure that you include the following information with your order, as we cannot process your order without this information:
     (a) name,
     (b) e-mail address,
     (c) contact telephone number,
     (d) preferred time for telephone contact,
     (e) card type,
     (f) full name as displayed on the card, the credit card number, and expiry date of the card,
     (g) billing address,
     (h) delivery address for saliva collector kits (this need not be the same as the billing address),
     (i) the items you require.
Acceptance of orders
1. All orders are subject to acceptance by us.
2. Once we have received your order, we will endeavour to confirm the details of your order on the website with a copy of the details of your order being sent to you by e-mail.
Delivery of Saliva Collector Kits
1. We aim to deliver your saliva collector kit within seven days, however delays may occur if saliva collector kits are out of stock. You will be advised of stock availability when we process your order.
2. The delivery charges that apply to your purchases are specified on the webpage.
3. In the event that some of the items you have ordered are out of out of stock we may send your order to you by making two or more deliveries. You will only pay one delivery charge. We will meet any additional delivery charges.
4. If the saliva collector does not arrive within the time specified above please contact us at info@geneplanet.com quoting the receipt number, which you will receive following completion of the checkout process.
5. Please retain the invoice, which will be sent separately, as it will be required should you decide to avail of our cancellation and refunds policy set out below.
Results of Genetic Testing
1. In circumstances where we carry out genetic testing of your DNA, we aim to deliver the results to your account within thirty days of receiving your saliva sample. You will be advised by e-mail when the results have been delivered to your account.
2. The initial fee you pay for these results includes their storage on your account for one year after delivery. The information (including results), content graphics, text, sounds, images, buttons, trade marks, service marks, trade names and logos (the “Materials”) contained in this website are protected by copyright and other intellectual property laws. Subject to compliance at all times with these Terms and Conditions, we grant you for the duration of such time a non-exclusive licence, solely to the extent reasonably required for your own personal and non-commercial use, to read, display, view and download the Materials to a single computer and/or to print a single hard copy of the Materials provided however that all copyright, trademark and other proprietary notices are left intact. Any other use of this Website, its contents and its underlying software, including the reproduction, modification, distribution, transmission, republication, display or performance of the content on this Website is strictly prohibited.
3. When you make a purchase you will be issued with an unique password which allows you to access your user account. You are responsible for the security and proper use of this password and must take all reasonable steps to ensure that the password is kept confidential and is not disclosed to anybody else. You agree to notify us immediately if your password is lost or misused. Subject to appropriate security checks, you will be issued with a new password.
4. You are responsible for ensuring that no unauthorised access is obtained into your account. You will be entirely liable for all activities conducted through your account whether authorised by you or not until you have notified us of such unauthorised use and we have stopped access to your user account. If we have reason to believe that there is likely to be a breach of security or misuse of your account, we may change any or all of your password or security code and notify you accordingly.
5. We reserve the right to suspend or terminate forthwith your right to use you user account if we have reason to believe that your password is being misused.
Website Access
1. We will make the necessary arrangements to ensure that the Website is fully operational at all times. However, due to the nature of interactive services and the internet generally, we cannot guarantee that the Website will be free from delays, interruptions or errors and access to the Website may be suspended (whether by us or due to external causes) temporarily and/or without notice. We will not be liable for any loss or damage arising from the Website not being available (whether for internal processing reasons or otherwise).
2. We may restrict, suspend or terminate your use of the Website if it believes that you have breached these Terms and Conditions at any time. The suspension or termination of the Website will be without prejudice to any rights which we may have against you in respect to your breach of these Terms and Conditions.
Price and Payment
1. Prices are written on our web site and include VAT at 21,5%. GenePlanet reserves the right to change its prices at any time. Irrespective of any change of prices, you will be charged the price which was specified for the good when you ordered.
2. You can pay by credit card. We accept Visa, Mastercard, Eurocard or Laser. All credit card purchases are subject to validation and credit checks.
Right of Cancellation and Refunds
1. You have the right to cancel any item or service you have ordered on this Website and obtain a full refund, subject to the following:
  - Where you have purchased a saliva collector kit, you may cancel your purchase within seven working days of receiving the saliva collector kit. You must return the saliva collector kit to us unused, complete and in a re-saleable condition. Saliva collector kits which are returned for a refund must be returned with the invoice. Your statutory rights are not affected;
  - Where you have purchased genetic testing services, you may cancel your purchase within seven working days of the date on which we confirm your purchase as long as you have not accessed your results within that period.
2. We seek to ensure that you are happy with your purchases. If you are unhappy with any goods or services which you have purchased from us please contact us at info@geneplanet.com
3. Apart from your cancellation right, where any valid claim in respect to any item or service sold by us is based on any defect in the quality or condition of the items or service or their failure to meet specification, we shall be entitled to replace the goods or service (or the part in question) free of charge or, at our sole discretion, refund the price of the items or service (or a proportionate part of the price), but we shall have no further liability to the purchaser to the fullest extent permitted by law.
Warranties and Disclaimers
1. By placing an order, you warrant that:
  - You are legally capable of entering into this binding contract;
  - You are at least 18 years old; and
  - Where you send us a saliva sample relating to third person, you have full permission and explicit consent from that person who must be at least 18 years old.
2. WHILST ALL REASONABLE EFFORTS ARE MADE TO ENSURE THAT ANY INFORMATION, INCLUDING THE RESULTS, SUPPLIED BY US IS CORRECT, WE MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, IN RELATION TO THE TIMELINESS, ACCURACY OR COMPLETENESS OF SAID INFORMATION. ANY CONTENT OR INFORMATION RECEIVED ON OR VIA THE WEBSITE SHOULD NOT BE RELIED ON FOR IMPORTANT PERSONAL AND MEDICAL DECISIONS, AND YOU SHOULD CONSULT AN APPROPRIATE PROFESSIONAL FOR ADVICE WHICH IS SPECIFICALLY TAILORED TO YOUR PARTICULAR CIRCUMSTANCES.

We make no representations, warranties or undertakings that the Website, or the server that makes it available, will be compatible with your equipment or free from defects, including but not limited to viruses or other harmful elements. We accept no liability for any infection by computer virus, bug, tampering, unauthorised access, intervention, alteration or use, fraud, theft, technical failure, error, omission, interruption, deletion, defect, delay, or any event or occurrence beyond our control, which corrupts or affects the administration, security, fairness and integrity or proper conduct of any aspect of the Website or your equipment.
4. Except as expressly set out in these Terms and Conditions, all representations, warranties, terms and conditions whether express or implied in relation to this Website or the information contained therein are hereby excluded to the fullest extent permitted by law.
5. Please note that any limitations or exclusions set out in these terms and conditions of sale shall not operate to affect any statutory rights to which you are entitled to as a consumer.
Indemnity

You agree to indemnify us and keep us indemnified in respect to all loss or damage suffered by it in connection to your use of the Website in breach of these Terms and Conditions and in respect of all claims or legal proceedings brought or threatened against it by any third party which arise in connection to your use of the Website in breach of these Terms and Conditions.
